2. Prohibited Activities and Behaviors

The following activities are strictly prohibited and may result in immediate termination of services and potential legal action:

Financial Misconduct:

  • • Money laundering or illegal financing
  • • Fraud or misrepresentation of assets
  • • Tax evasion or illegal tax schemes
  • • Bribery or corrupt payments

Behavioral Violations:

  • • Harassment or threatening behavior
  • • Discrimination or hate speech
  • • Interference with other transactions
  • • Unauthorized recording or surveillance

3. Content Guidelines and Restrictions

When using our website or providing content for marketing materials, you must ensure all content complies with Cyprus law and professional standards.

  • • No false or misleading property information
  • • No copyrighted materials without permission
  • • No defamatory or harmful content about competitors
  • • No content that violates privacy rights

4. Age Restrictions and Requirements

Our services are available only to individuals who are 18 years or older and have legal capacity to enter into binding contracts under Cyprus law. Minors may only engage our services through legal guardians or authorized representatives.

Liability Limitations and Warranties

1. Professional Service Standards

HomeBridge provides professional real estate services with reasonable skill and care expected of licensed real estate professionals in Cyprus. However, we cannot guarantee specific outcomes or results.

What we provide: Professional expertise, market knowledge, transaction support, and compliance with regulatory requirements within industry standards.

2. Disclaimer of Warranties

IMPORTANT LEGAL NOTICE: READ CAREFULLY

NO WARRANTIES: Our services are provided "as is" without warranties of any kind, express or implied, including but not limited to:

  • • Warranties of merchantability or fitness for particular purpose
  • • Guarantees of property value appreciation or investment returns
  • • Assurance of transaction completion or timing
  • • Warranties regarding market conditions or economic factors

3. Limitation of Liability

Our liability for any claims arising from our services is limited to the fees paid for the specific service in question, not to exceed €10,000 in any single claim or €25,000 in aggregate per calendar year.

Excluded damages: We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost opportunities, or market losses.

4. Consequential Damages Exclusion

Under no circumstances shall HomeBridge be liable for any consequential, incidental, indirect, special, or punitive damages, even if we have been advised of the possibility of such damages.

This includes but is not limited to: loss of business opportunities, loss of rental income, financing delays, or changes in property market conditions.

5. Force Majeure Provisions

HomeBridge shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, government actions, pandemic restrictions, or significant economic disruption.

Legal Information and Dispute Resolution

1. Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of the Republic of Cyprus. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts of Cyprus.

Applicable Laws: Cyprus Real Estate (Agents and Estate Agents) Laws, Cyprus Companies Law, European Union regulations where applicable, and international property law conventions.

2. Dispute Resolution Procedures

Before initiating formal legal proceedings, parties agree to attempt resolution through the following process:

  1. Step 1: Direct negotiation between parties within 30 days of dispute notice
  2. Step 2: Mediation through Cyprus real estate professional mediation service
  3. Step 3: Binding arbitration if mediation fails, conducted in Limassol, Cyprus
  4. Step 4: Court proceedings as last resort through Cyprus court system

3. Severability Clause

If any provision of these Terms and Conditions is found to be unenforceable or invalid by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remainder of these terms shall remain in full force and effect.

4. Terms Modification Policy

HomeBridge reserves the right to modify these Terms and Conditions at any time with 30 days written notice to active clients. Continued use of our services after the effective date constitutes acceptance of modified terms.

Material changes will be highlighted and explained in modification notices. You may terminate services if you do not agree to material modifications.

  • • Third-party claims related to your conduct

Agreement Acknowledgment

By engaging our services or using our website, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree with any provision, you must discontinue use of our services immediately.
